These Terms of Service govern your use of the KYRGYZ TOURS website and the tours and travel services we offer. By using the website, making an enquiry or confirming a booking, you agree to these terms.
1. Enquiries and bookings
An enquiry, quote or itinerary is not a confirmed booking and does not oblige either party to proceed. A booking becomes binding only when we confirm availability in writing and receive the deposit or payment agreed for your trip. Your written confirmation, itinerary and invoice form part of the agreement and may contain trip-specific terms that take priority where they differ from these general terms.
Please review all names, dates, passport details where required, services and traveller details in your confirmation. Notify us promptly of any error or change. We cannot be responsible for costs arising from inaccurate information supplied after tickets, permits or supplier services have been arranged.
2. Prices and inclusions
Unless stated otherwise, prices are quoted in US Dollars (USD) per person and are based on the group size, dates, route and services specified in your quote. Tour descriptions and confirmations identify the main inclusions and exclusions. International flights, visas, insurance, personal expenses, tips, meals or activities not expressly listed as included are normally excluded.
Prices may change before written confirmation if supplier costs, exchange rates, taxes, fuel costs or itinerary requirements change. After confirmation, any price change will be discussed with you where practical and permitted by applicable law. A quotation is valid only for the period stated in it.
3. Payment
The required deposit, balance due date and accepted payment method will be stated in your quotation or confirmation. A deposit secures services only after it has been received and acknowledged by us. Failure to pay the balance by the stated date may be treated as a cancellation and may result in the release of reserved services.
Any bank, card, currency-conversion or transfer charges are the traveller's responsibility unless we confirm otherwise in writing. Payment of a deposit or balance confirms that you have read and accepted the applicable booking conditions.
4. Changes, cancellation and refunds
Requests to change or cancel a booking must be made in writing. We will try to accommodate a requested change, but it may depend on supplier availability and additional costs. Cancellation charges, if any, depend on the trip, the notice period and non-refundable costs already committed to suppliers.
The specific cancellation terms in your booking confirmation apply to your trip. Refunds, where due, are processed after we have received any recoverable amounts from relevant suppliers and may be reduced by documented non-refundable costs. We recommend travel insurance that includes cancellation and interruption cover.
5. Traveller responsibilities
You are responsible for holding a valid passport, visa and all documents required for entry and travel; meeting the stated fitness and equipment requirements; following guide and safety instructions; and promptly disclosing medical, dietary or accessibility needs that may affect your participation. Comprehensive travel insurance covering medical treatment, emergency evacuation, trip cancellation and personal belongings is strongly recommended and may be required for certain activities.
6. Itinerary changes and force majeure
Mountain travel can be affected by weather, road conditions, border restrictions, safety concerns, natural events, supplier availability and other circumstances outside reasonable control. We may alter a route, accommodation, activity, vehicle or schedule when reasonably necessary for safety or operational reasons. Such adjustments do not normally constitute a material change where the overall nature and value of the trip can still be delivered.
If we must cancel a service before departure, we will offer a reasonable alternative where practical or refund amounts paid for the affected service, subject to our recovery from suppliers where applicable. We are not responsible for additional expenses caused by events outside our reasonable control, such as changes to international transport, government action, severe weather or natural disasters.
7. Risk, health and limitation of liability
Trekking, driving on mountain roads and other adventure activities involve inherent risks, including changing weather, altitude, terrain, wildlife and limited access to medical facilities. You must tell us before departure about any health condition, medication, allergy, dietary need or mobility issue that could materially affect your participation or safety. We may decline or modify participation where a qualified guide reasonably considers it unsafe.
We take reasonable care in arranging services and working with qualified local providers, but we are not responsible for loss, injury, delay or damage caused by risks inherent in travel, your own acts or omissions, or events beyond our reasonable control, except where liability cannot lawfully be excluded. Nothing in these terms limits any rights that cannot legally be waived.
8. Conduct, website use and governing law
Travellers must act respectfully towards local communities, guides, other guests, wildlife and the environment, and comply with reasonable safety instructions. We may remove a participant from an activity or trip if their conduct creates a safety risk or seriously disrupts the experience of others; in that event, no refund is due for unused services.
Website content is provided for general information and may be updated without notice. You may not misuse the website, interfere with its operation or reproduce its content without permission. These terms are governed by the laws of the Kyrgyz Republic. Any dispute should first be raised with us in writing so that we have an opportunity to resolve it directly.
